Who we are
These Terms of Service govern your use of the sessions offered by Nikita Pandey, a meditation facilitator based in India. By registering for any session, you agree to these terms and to our Privacy Policy, which describes how we collect, use, and protect your personal data. Participants
Eligibility and Participation
Our sessions are open to women aged 24 to 30 only. These sessions have been intentionally designed for women in this specific phase of life.
Participants must register for themselves and personally attend the sessions. Registrations made on behalf of another person are not permitted. Your session cannot be transferred to another person.
By registering, you confirm that you meet these criteria. We reserve the right to cancel any registration where these requirements are not met. In the event of removal, see the Cancellation and Refunds below.
Participant conduct
Participants are expected to engage respectfully throughout all sessions. Nikita Pandey reserves the right to remove any participant whose behaviour is determined, in her reasonable judgement, to be disruptive or harmful to the group. Given the group nature of these sessions, such a determination will be informed by the impact on other participants present. In the event of removal, see the Cancellation and Refunds below.
Sessions
Pause sessions
Pause is a free 15-minute live group session on Zoom, open to women aged 24 to 30 only. The session is never recorded. Each time slot holds a limited number of participants and is allocated on a first-come, first-served basis.
To register, you will be asked to provide your full name, email and a selection of one of the available time slots. You will also be required to confirm your eligibility based on age and gender, and your acceptance of these Terms of Service and Privacy Policy.
Upon registration, you will be redirected directly to the session Zoom link. The host will admit participants when the session is ready to begin. Attendance of a Pause session is required before registering for Presence sessions. The email used for Pause registration must be used for Presence registration.
Presence sessions
Presence comprises 10 live group sessions on Zoom, open only to women aged 24 to 30 who have attended a Pause session. Sessions are never recorded. Each time slot holds a limited number of participants and is allocated on a first-come, first-served basis. If your preferred time slot is full, please contact us at hello@nikitapandey.net to discuss availability.
To register, you must confirm that you have attended a Pause session. Your Presence time slot will be the same as your Pause session. You will be asked to provide your email that you used for Pause registration and accept the EU statutory right of withdrawal, these Terms of Service, and our Privacy Policy.
After completing your registration form, you may proceed to payment by clicking the button available on this page, which will direct you to PayPal to complete your payment. Your registration will be confirmed and session details will be sent after receipt of full payment is verified.
Missed sessions
If you miss a session, it cannot be rescheduled or replayed. Consistency is your responsibility.
Recordings
Sessions are never recorded. Participants are strictly not permitted to record sessions by any means, in order to protect the privacy and safety of all participants present. Violation of this rule will result in immediate removal from Presence sessions. Refunds in this case will be governed by the Cancellation and Refunds section below.
Payment & Cancellation
Payment
During registration, you will be asked to confirm your consent regarding the EU statutory withdrawal period before proceeding to payment. After completing your registration form, you may proceed to payment by clicking the payment button below the registration form. You will then be directed to PayPal, a service provided by PayPal Payments Private Limited, to complete your payment. Your Presence registration will be confirmed only upon receipt of full payment. We do not store your payment details.
EU right of withdrawal
If you are located in the European Economic Area, you have the right to withdraw from the purchase of Presence sessions within 14 days of the date your payment is confirmed, without giving any reason, under EU consumer law.
By completing presence registration, you expressly request that the Presence sessions commence on your first scheduled date, which falls within the 14-day withdrawal period, and you acknowledge that your right of withdrawal will be lost once your first session has commenced. This consent is confirmed by your explicit acknowledgement at the point of presence registration.
To exercise your right of withdrawal, please use the withdrawal form accessible via the 'Withdraw from contract' button on our website. You will be asked to provide your full name, email, time slot and PayPal transaction ID. Your refund will be processed within 14 days of receipt of your withdrawal request.
Cancellation and refunds
To request a cancellation, please use the cancellation form accessible via the 'Cancel Presence' button on our website. You will be asked to provide your name, email address, PayPal transaction ID, and time slot. The refund amount will be calculated by us based on our records of sessions attended and communicated to you following verification. Refunds will be processed via the original payment method within 14 days of confirmation.
Facilitator-initiated cancellation
In the event that Nikita Pandey needs to cancel one or more sessions for any reason, affected sessions will be rescheduled to a mutually agreeable time and participants will be notified promptly. Every reasonable effort will be made to complete all 10 sessions.
In the exceptional circumstance that the sessions cannot be completed and rescheduling is not possible, participants will receive a refund proportionate to the sessions not yet delivered, calculated as a fraction of the total amount paid.
No medical or therapeutic claims
The sessions offered by Nikita Pandey are not therapy, counselling, or any form of medical or psychological treatment. They are meditation sessions rooted in ancient Indian wisdom. If you are experiencing a mental health condition or any other medical concern, please consult a qualified professional. Nikita Pandey accepts no liability for any outcomes arising from participation in sessions.
Limitation of liability
To the maximum extent permitted by applicable law, Nikita Pandey's total liability to you for any claim arising from participation in sessions shall not exceed the amount paid by you for the session in question. This limitation does not apply to liability arising from death or personal injury caused by negligence, fraud, gross negligence, or where liability cannot be excluded under applicable law.
Intellectual property
The session structure, teaching approach, and verbal instructions delivered by Nikita Pandey during sessions are her original work. Participants may not reproduce or share session content without permission. Meditation and breathing techniques used in sessions are drawn from ancient traditions in the public domain.
Force majeure
We will not be liable for any failure to deliver sessions due to circumstances beyond our reasonable control, including but not limited to technical failures of third-party platforms such as Zoom, internet outages, power failures, illness, or other unforeseen events. In such cases, we will make reasonable efforts to reschedule the affected session and notify you promptly.
Legal
Governing law
These Terms of Service are governed by the laws of India. However, where you are located in the European Economic Area, mandatory consumer protection laws of your country of residence will also apply and cannot be excluded by this clause.
Dispute resolution
In the event of any dispute arising from these Terms, we will first attempt to resolve the matter amicably through direct communication. If a resolution cannot be reached, the dispute shall be subject to the jurisdiction of the courts of India, without prejudice to your rights as an EU consumer to bring proceedings before the courts of your country of residence.
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable under applicable law, that provision will be deemed modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible. The remaining provisions will continue in full force and effect.
Language
These Terms of Service are written in English. In the event of any conflict arising from a translation, the English version shall prevail.
Changes to these terms
We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated date. Changes will not apply retroactively to participants already enrolled in Presence sessions. Where material changes are made, registered participants will be notified by email at least 14 days before the changes take effect.
